The Terms of Services is a legal agreement between you, as Customer, Administrator, User/End User, and TXT E Solutions Inc. and govern your use and access to TXT E Solutions services, including our product, software, hardware, tools, features and any other services made available through our website.

By using the Services or Products in any way, you agree to and accept these Terms, our Privacy Policy, and any other guidelines posted on the website.

If you do not agree to these Terms or are under the age of 18, do not use the services.

If you are accepting these Terms on behalf of your employer or another entity or for use of the Services or Products by your employer or another entity, you represent and warrant that a) you have the legal authority to bind the applicable entity to these Terms, b) you are 18 years or older, and c) that you agree on behalf of your employer or the entity you represent, to these Terms.

If you don’t have the legal authority to bind your employer or the entity you represent to these Terms, you should not countersign these Terms.

If you are accepting these Terms on your own for your use of the Services or Products as a Customer with an account, you agree that you have the legal authority to agree to these Terms and are 18 years or older.

If you are using the Services or Products as an End User, you agree and acknowledge that the Customer and its administrator can access, disclose, restrict and remove information in or from an End User account.

If you are using the Services or Products as both a Customer and an End User, you are accepting these Terms as both a Customer and an End User with a TXT E Solutions account.

For any use of Hardware by End Users, including damage and misuse of the Hardware, it is the Customer’s responsibility and TXT E Solutions will have no role in the same.

Customer is responsible for obtaining consents and complying with any laws necessary to allow the operation of Services or Products.

Customer may not permit sharing of End User accounts or passwords. Customer agrees to a) prevent any unauthorized access, sharing, or use by End-users and terminate any unauthorized use of or access to the Services and b) provide TXT E Solutions with notice of any such unauthorized access or use.

The End User and Customer must be legally authorized to operate a Commercial Motor Vehicle on the roads and public highways of the United States, Mexico and Canada.

Use Policy:

The Customer or End User is responsible to ensure that it will operate the equipment with the sole intent to comply with regulations. At any given point in time, the customer must not use the equipment and services to breach the E-Log regime.

The Sim Card provided has unlimited data access, the customer or end-user is prohibited from using it for any other purpose than TXT ELD.

TXT E Solutions reserves the right to make any, changes, updates to its applications – both software and hardware – as and when required.

The Customer or End User must agree to pay the billing amount from the date of activation, regardless of the use of Equipment. The equipment once delivered to the customer or end-user; it will become the date of activation.

The Customer or End User shall pay the total equipment cost or additional equipment costs. Delivery charges will be paid by the customer or end-user.

Return Policy:

The equipment can be returned within 7 days of purchase in good condition. Any applicable refund will be processed once approved within 14 business days once the device is received in good and working condition. The Customer or End User acknowledges that it is liable to pay TXT the full value of the equipment, regardless of the usage of the equipment.

TXT E Solutions will only consider the equipment as returned only if a complete set of hardware including Hardwired Terminal, Case, mounting Stand, SD Card (if provided), Sim Card and Connector is returned in good and working condition. TXT E Solutions reserves the right to impose charges in case of any missing hardware, which will be considered as lost/broken.

The Customer or End-user agrees to pay the Vendor’s subscription and usage fee (as per their plan) for each month. The subscription fee is not conditional or is not subjected to any other term. Cancellation of the monthly subscription will be always considered from the next month.

TXT E Solutions reserves the right to not extend any warranty for any damaged or broken hardware.

The billing cycle will start from 1st of every month. Post 15th of the following month, TXT E Solutions will charge for half-month as monthly subscription charge.

Additional Accessories or Equipment is always billable. Accessory or Equipment will only be considered as replace if the faulty one is returned within 10 calendar days. Failing to adhere to the timeline will invite applicable charges.

Condition of the Equipment:

The Customer or End-User agrees and acknowledges that it has inspected the Equipment and acknowledges that the Equipment is in good and acceptable condition.

The Customer or End-User takes sole responsibility to undertake all required steps to conduct a pre-delivery inspection to its satisfaction and reject Equipment before delivery.

TXT E Solutions reserves the right to replace to any item in the Equipment list, if any hardware malfunctions are reported, within one year of purchase of the device without any charge. This is valid only if the said item is not damaged by the Customer or End-User. Water and Physical damages are not covered under this warranty. We do not extend any warranty for the accessories.
